These Terms of Service ("Terms") govern your use of kyder.io (the "Site"), operated by Kyder. By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
About the Site
The Site provides general information about Kyder and its outbound business development and related services. Nothing on the Site creates a client relationship or obligates Kyder to provide services.
Any engagement, scope, pricing, payment terms, deliverables, or performance criteria must be included in a separate written agreement. If that agreement conflicts with these Terms regarding paid services, the separate agreement controls.
Acceptable use
You may use the Site only for lawful purposes. You may not interfere with the Site's operation or security, attempt unauthorized access, introduce harmful code, scrape or copy Site content without permission, impersonate another person, submit unlawful or harmful content, or violate the rights of others.
Intellectual property
The Site and its content, including its text, graphics, branding, and designs, are owned by Kyder or used with permission. You may not reproduce, modify, distribute, sell, or commercially use Site content without Kyder's prior written permission, except as allowed by law.
Third-party links
The Site may link to third-party websites or services. Kyder does not control and is not responsible for their content, availability, security, or privacy practices.
No guarantee of results
Website content may describe methods, goals, examples, or potential outcomes. Unless expressly stated in a separate written agreement, Kyder does not guarantee any number of leads, replies, meetings, qualified opportunities, customers, revenue, or other business result.
Disclaimers and limitation of liability
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Kyder disclaims implied warranties and is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, opportunities, goodwill, or reputation arising from use of the Site.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Changes
Kyder may update the Site or these Terms at any time. Updated Terms take effect when posted unless a later date is stated. Continued use of the Site after an update means you accept the revised Terms.
Governing law
These Terms are governed by California law. Any dispute relating to the Site or these Terms must be brought in the state or federal courts located in Santa Clara County, California, unless applicable law requires otherwise.
